Probate written on chalk boardThis article is being written to conclude the series on the duties bestowed upon executors during a Connecticut probate. We consider this an important topic to address as individuals seldom become executors by choice. Instead, they find themselves in this role after having been named as such in a will. Moreover, executors typically have their own personal obligations (IE work and family) which must be maintained. We wrote this series, therefore, with the goal of providing information which will help all involved with understanding what to expect as the case moves forward. It has also been our goal to provide information which will assist with the selection of an attorney. Several topics were addressed over our recent articles. Issues which we analyzed included:

We chose to address these particular topics for multiple reasons. First, some make the mistake of thinking that they are “automatically” the executor of an estate if they are named as such in a will. This is not the case. One may not begin to take action on the matter until they have been approved by the Court. Second, there are several requirements which one must complete including providing notice to interested parties, inventorying the estate, etc. Failing to meet these obligations can result in the case being delayed and in one being removed as executor. Third, if one fails to meet the fiduciary duties which they owe to the heirs then there is a chance that they may face personal liability. Finally, retaining qualified counsel is often in the best interests of the executor as having representation helps to ensure that things go smoothly.
